Government of India Mandates Retail Sale Price (RSP) Display on All Pan Masala Packs

In a significant move to enhance consumer protection and streamline GST compliance, the Ministry of Consumer Affairs, Food & Public Distribution has announced amendments to the Legal Metrology (Packaged Commodities) Rules, 2011. The Legal Metrology (Packaged Commodities) Second (Amendment) Rules, 2025, notified through G.S.R. ​ 881(E), will come into effect on 1 February 2026. ​ This landmark decision aims to ensure transparency in pricing and declarations for all pan masala packs, regardless of their size or weight. ​

Key Changes Introduced ​

The amendments bring several critical changes to the packaging and labeling of pan masala products:

  1. Mandatory Retail Sale Price (RSP) Display:
    • All pan masala packs, including small packs of 10 grams or less, which were previously exempted, must now display the Retail Sale Price (RSP) on their labels. ​ This ensures that consumers are fully informed about the price of the product they are purchasing. ​
  2. Full Compliance with Declarations:
    • Every pan masala package must include all mandatory declarations as per the Legal Metrology (Packaged Commodities) Rules, 2011. ​ This includes details such as weight, manufacturer information, and other relevant data. ​
  3. Removal of Exemptions for Small Packs:
    • The earlier exemption under Rule 26(a), which allowed smaller packs to avoid certain declarations, has been withdrawn. ​ A new proviso specific to pan masala has been inserted, ensuring uniformity across all pack sizes. ​

These changes are designed to empower consumers by providing clear and transparent pricing information, eliminating misleading or deceptive practices, and enabling better-informed purchasing decisions. ​

Impact on GST Compliance and Revenue Collection ​

The amendments also play a crucial role in supporting GST compliance. ​ By mandating the display of RSP on all pan masala packs, the government aims to facilitate the effective implementation of RSP-based GST levies. ​ This will ensure:

  • Seamless Enforcement of GST Council Decisions: The uniform display of RSP will simplify the process of tax assessment and enforcement. ​
  • Improved Revenue Collection: Proper tax assessment across all pack sizes, including the smallest units, will help boost revenue collection and prevent tax evasion. ​

Implementation Timeline
