CBIC

Dated: 21.06.2025

The Central Board of Indirect Taxes and Customs (CBIC) has issued Notification No. 16/2025-Customs (ADD) dated 20th June 2025, announcing the imposition of Anti-Dumping Duty (ADD) on the import of certain goods into India. This action is taken under the provisions of the Customs Tariff Act, 1975, and in line with the findings of the Directorate General of Trade Remedies (DGTR) to curb unfair trade practices and protect domestic manufacturers.

Legal Foundation

The notification is issued in exercise of the powers conferred by:

  • Section 9A(1), (5), and (6) of the Customs Tariff Act, 1975, and
  • Rule 18 of the Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995.

It follows the final findings of the DGTR, which confirmed that certain goods are being exported to India at prices significantly below their normal value, thereby causing injury to domestic producers.

Key Features of Notification 16/2025

  • Product Involved: The Anti-Dumping Duty applies to specific products, typically defined by a Customs Tariff Heading (CTH) or HS Code. Full product description and specifications are provided in the annex to the notification.
  • Countries Concerned: The notification identifies the countries from where dumping has occurred. These typically include countries like China PR, South Korea, or others as specified.
  • Duty Duration: The ADD will be in force for five years from the date of publication, unless modified earlier.
  • Rate of Duty: The notification prescribes specific ADD rates depending on the country of origin, exporter/producer, and product specifications.
  • Customs Implementation: The duty shall be collected by Customs Authorities at the time of import clearance, and will be over and above any other applicable duties.

Impact on Importers and Industry

  • For Importers:
    • Importers of the specified goods will need to factor in the ADD while planning their costing and pricing strategy.
    • Misdeclaration or circumvention may lead to penalty proceedings under the Customs Act.
  • For Domestic Industry:
    • This measure is intended to provide relief and a level playing field for domestic manufacturers.
    • It encourages fair competition and discourages predatory pricing by foreign exporters.

Conclusion

CBIC Notification No. 16/2025-Customs (ADD) is a significant step in India’s ongoing effort to safeguard its domestic industries from unfair import pricing and dumping practices. Stakeholders, particularly importers and customs brokers, are advised to go through the full text of the notification and associated DGTR findings to ensure compliance.
