DGFT Revises Guidelines for End-User Certificates in Foreign Trade Policy 2023
The Directorate General of Foreign Trade (DGFT), under the Department of Commerce, Government of India, has issued Public Notice No. 23/2025-26, dated October 1, 2025, announcing a significant amendment to Para 2.35 of the Handbook of Procedures, 2023. This amendment, made under the powers conferred by Paragraphs 1.03 and 2.04 of the Foreign Trade Policy, 2023, introduces changes to the issuance of End-User Certificates (EUCs) for both freely importable and restricted items. The revised provisions are effective immediately.
Key Changes in Para 2.35
The amendment revises the existing provisions for issuing End-User Certificates (EUCs) by Regional Authorities (RAs). Below are the key updates:
- Issuance of EUCs for Freely Importable and Restricted Items:
- Previously, RAs were authorized to issue EUCs for freely importable items if a foreign government required certification of the end user before permitting export from their country.
- Under the revised provision, RAs are now authorized to issue EUCs for both freely importable and restricted items.
- Conditions for Restricted Items:
- For restricted items, the EUC will only be issued if the item has been granted a restricted authorization by the DGFT.
- The EUC will strictly adhere to the quantity and value specified in the restricted authorization.
- Application Process:
- The EUC will be issued based on an application made under ANF 2J, along with the prescribed documents.
- The process remains aligned with Appendix 2Q of the Appendices and Aayat Niryat Forms.
Effect of the Public Notice
The amendment ensures that the issuance of EUCs for restricted items is strictly regulated. By linking the EUC to the restricted authorization granted by the DGFT, the government aims to maintain tighter control over the import of restricted items. This change is expected to enhance compliance and transparency in the import process.

- For Importers:
- Importers of restricted items must ensure that they have a valid restricted authorization from the DGFT before applying for an EUC.
- The quantity and value of the items in the EUC must match the details in the restricted authorization.

- Exporters dealing with foreign governments that require end-user certification for items being exported to India must ensure that the importer has obtained the necessary EUC from the RA.
- Streamlined Process:
- The amendment simplifies the process for obtaining EUCs by clearly defining the conditions under which they can be issued, thereby reducing ambiguity.
