CBIC Extends Anti-Dumping Duty on Polyethylene Terephthalate Resin Imports from China
The Government of India, through the Ministry of Finance (Department of Revenue), has issued Notification No. 39/2025-Customs (ADD) dated 26th December 2025, announcing the extension of anti-dumping duty on imports of “Polyethylene Terephthalate (PET) resin having an intrinsic viscosity of 0.72 decilitres per gram or higher” originating in or exported from China PR. This notification is a significant development in India’s trade policy aimed at protecting domestic industries from unfair trade practices.
Background of the Notification
The anti-dumping duty on PET resin imports from China PR was initially imposed by Notification No. 18/2021-Customs (ADD) dated 27th March 2021. This duty was introduced to counter the dumping of PET resin into the Indian market, which was causing material injury to domestic manufacturers. Dumping refers to the practice of exporting goods at prices lower than their normal value, which can harm the local industry by creating unfair competition.
In September 2025, the Directorate General of Trade Remedies (DGTR) initiated a review of the anti-dumping duty under Notification No. 07/15/2025-DGTR dated 23rd September 2025. The review was conducted in accordance with sub-section (5) of section 9A of the Customs Tariff Act, 1975, and rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995. The purpose of the review was to assess whether the continuation of the anti-dumping duty was necessary to prevent further injury to the domestic industry.
Key Highlights of Notification No. 39/2025-Customs (ADD)
- Extension of Anti-Dumping Duty: The notification extends the validity of the anti-dumping duty on PET resin imports from China PR until 26th June 2026. This extension ensures that the duty remains in force for an additional period of six months beyond its original expiration date.
- Legal Framework: The extension is made under the powers conferred by sub-sections (1) and (5) of section 9A of the Customs Tariff Act, 1975, read with rules 18 and 23 of the Customs Tariff (Anti-dumping Rules), 1995.
- Amendment to Principal Notification: The principal notification, No. 18/2021-Customs (ADD), has been amended to include a new paragraph (Paragraph 3), which explicitly states the extended validity of the anti-dumping duty.
- Objective: The extension aims to safeguard the interests of domestic manufacturers of PET resin by preventing the recurrence of dumping practices that could harm the industry.
