CBIC

Dated: 28.04.2026

TheΒ CentralΒ BoardΒ ofΒ IndirectΒ TaxesΒ &Β CustomsΒ (CBIC)Β hasΒ issuedΒ aΒ significantΒ clarificationΒ regardingΒ theΒ eligibilityΒ forΒ dutyΒ drawbackΒ underΒ SectionΒ 74Β ofΒ theΒ CustomsΒ Act,Β 1962,Β forΒ goodsΒ suppliedΒ fromΒ SpecialΒ EconomicΒ ZonesΒ (SEZ)Β toΒ theΒ DomesticΒ TariffΒ AreaΒ (DTA)Β andΒ subsequentlyΒ re-exported.Β

ThisΒ articleΒ providesΒ aΒ comprehensiveΒ overviewΒ ofΒ theΒ clarification,Β itsΒ legalΒ basis,Β andΒ itsΒ implicationsΒ forΒ businessesΒ operatingΒ inΒ SEZsΒ andΒ DTAs.

Background

Recent audits highlighted inconsistencies in how customs authorities processed duty drawback claims for goods cleared from SEZs to DTAs and then re-exported. Some customs field formations denied drawback claims, arguing that such clearances did not constitute imports, leading to confusion and operational challenges for businesses.

Legal Framework

1. SEZ Act, 2005

  • SectionΒ 30:Β GoodsΒ removedΒ fromΒ anΒ SEZΒ intoΒ theΒ DTAΒ attractΒ customsΒ duties,Β includingΒ anti-dumping,Β countervailing,Β andΒ safeguardΒ duties,Β asΒ perΒ theΒ CustomsΒ TariffΒ Act,Β 1975.Β TheΒ applicableΒ dutyΒ rateΒ andΒ valuationΒ areΒ determinedΒ onΒ theΒ dateΒ ofΒ removalΒ fromΒ theΒ SEZΒ or,Β ifΒ notΒ ascertainable,Β onΒ theΒ dateΒ ofΒ dutyΒ payment.
  • SectionΒ 2(o):Β DefinesΒ ‘import’Β inΒ theΒ SEZΒ contextΒ asΒ bringingΒ goodsΒ intoΒ anΒ SEZΒ fromΒ outsideΒ IndiaΒ orΒ fromΒ anotherΒ SEZ.

2. Customs Act, 1962

  • SectionΒ 74:Β AllowsΒ forΒ dutyΒ drawbackΒ onΒ re-exportedΒ goodsΒ thatΒ wereΒ previouslyΒ importedΒ intoΒ IndiaΒ andΒ areΒ easilyΒ identifiable.

Key Clarification by CBIC

The CBIC has clarified that:

  1. SEZΒ asΒ ForeignΒ Territory:Β ForΒ customsΒ andΒ tradeΒ operations,Β SEZsΒ areΒ treatedΒ asΒ foreignΒ territoryΒ withinΒ India.Β Thus,Β movementΒ ofΒ goodsΒ fromΒ anΒ SEZΒ toΒ theΒ DTAΒ isΒ consideredΒ anΒ import.
  2. EligibilityΒ forΒ Drawback:Β GoodsΒ clearedΒ fromΒ anΒ SEZΒ toΒ theΒ DTAΒ onΒ paymentΒ ofΒ applicableΒ duties,Β andΒ subsequentlyΒ re-exported,Β fulfillΒ theΒ conditionsΒ ofΒ SectionΒ 74Β ofΒ theΒ CustomsΒ Act.Β TheseΒ goodsΒ areΒ toΒ beΒ treatedΒ asΒ importedΒ forΒ theΒ purposeΒ ofΒ drawbackΒ claims.
  3. UniformΒ PracticeΒ Mandated:Β AllΒ customsΒ formationsΒ mustΒ processΒ drawbackΒ claimsΒ forΒ suchΒ re-exportedΒ goodsΒ inΒ accordanceΒ withΒ thisΒ clarification,Β ensuringΒ consistencyΒ andΒ legalΒ compliance.

Practical Implications

  • ForΒ DTAΒ Units:Β BusinessesΒ inΒ theΒ DTAΒ thatΒ purchaseΒ goodsΒ fromΒ SEZs,Β payΒ theΒ applicableΒ duties,Β andΒ laterΒ re-exportΒ theseΒ goodsΒ canΒ nowΒ confidentlyΒ claimΒ dutyΒ drawbackΒ underΒ SectionΒ 74,Β providedΒ theΒ goodsΒ areΒ easilyΒ identifiable.
  • ForΒ SEZΒ Units:Β ThisΒ clarificationΒ enhancesΒ theΒ attractivenessΒ ofΒ SEZsΒ asΒ aΒ sourceΒ forΒ DTAΒ units,Β knowingΒ thatΒ theΒ drawbackΒ mechanismΒ isΒ availableΒ uponΒ re-export.
  • ForΒ CustomsΒ Authorities:Β FieldΒ formationsΒ mustΒ alignΒ theirΒ practicesΒ withΒ thisΒ clarification,Β eliminatingΒ previousΒ inconsistenciesΒ andΒ reducingΒ disputes.

Example Scenario

  1. AΒ DTAΒ unitΒ purchasesΒ machineryΒ fromΒ anΒ SEZ,Β paysΒ theΒ requiredΒ customsΒ duties,Β andΒ laterΒ re-exportsΒ theΒ machineryΒ toΒ aΒ foreignΒ buyer.
  2. TheΒ DTAΒ unitΒ canΒ claimΒ dutyΒ drawbackΒ underΒ SectionΒ 74,Β asΒ theΒ machineryΒ isΒ treatedΒ asΒ importedΒ intoΒ IndiaΒ fromΒ theΒ SEZΒ andΒ isΒ easilyΒ identifiable.

Conclusion

ThisΒ CBICΒ clarificationΒ streamlinesΒ theΒ processΒ forΒ claimingΒ dutyΒ drawbackΒ onΒ goodsΒ suppliedΒ fromΒ SEZsΒ toΒ DTAsΒ andΒ thenΒ re-exported.Β ItΒ ensuresΒ legalΒ certainty,Β operationalΒ consistency,Β andΒ supportsΒ India’sΒ exportΒ competitivenessΒ byΒ removingΒ ambiguityΒ inΒ theΒ applicationΒ ofΒ SectionΒ 74Β ofΒ theΒ CustomsΒ Act,Β 1962.
