Extension of Anti-Dumping Duty Validity: Key Update for Importers and Industry Stakeholders
The Government of India has announced a significant update regarding anti-dumping duties through Notification No. 09/2026-Customs (ADD), issued by the Ministry of Finance (Department of Revenue) on May 22, 2026. This amendment extends the validity of anti-dumping duties imposed under a previous notification, impacting importers, manufacturers, and industry stakeholders.
What Is Anti-Dumping Duty?
Anti-dumping duty is a tariff imposed on imported goods that are priced below fair market value, often as a result of dumping by foreign producers. The purpose is to protect domestic industries from unfair competition and injury caused by such imports.
Details of the Notification
- Legal Authority:
- The extension is made under the powers granted by the Customs Tariff Act, 1975 and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995.
- Amendment Overview:
- The notification amends Notification No. 47/2021-Customs (ADD), originally issued on August 26, 2021.
- A new paragraph is inserted, stating: “Notwithstanding anything contained in paragraph 2, the anti-dumping duty shall remain in force up to and inclusive of 25th November, 2026, unless revoked, superseded or amended earlier.”
- Implications:
- The anti-dumping duty will now remain valid until November 25, 2026.
- The duty may be revoked, superseded, or amended before this date if the government decides.
Impact on Stakeholders
- Importers:
- Must continue to pay anti-dumping duties on affected goods until at least November 25, 2026.
- Should monitor for any further amendments or revocations.
- Domestic Manufacturers:
- Continued protection from unfairly priced imports.
- Opportunity to strengthen market position and competitiveness.
- Industry Analysts and Policy Makers:
- The extension signals ongoing vigilance against dumping practices.
- Provides a stable regulatory environment for planning and investment.
Historical Context
- The principal notification (No. 47/2021-Customs (ADD)) was first published in August 2021.
- It has been amended several times, most recently by Notification No. 13/2023-Customs (ADD) in November 2023.
- The current extension ensures continuity in anti-dumping measures.
Conclusion
This extension of anti-dumping duty validity until November 25, 2026, underscores the governmentβs commitment to protecting domestic industries from unfair trade practices. Stakeholders should stay informed about any further changes to these duties and adjust their strategies accordingly.
