India Amends SEZ Rules to Allow Returns, Resale and Repairs of Duty-Paid DTA Goods
Indiaβs Special Economic Zones (Third Amendment) Rules, 2026 introduce a clearer framework for SEZ units to bring duty-paid goods back from the Domestic Tariff Area (DTA), re-sell returned goods, and receive goods for repair.
The Ministry of Commerce and Industry notified the amendment on 15 October 2026 under section 55 of the Special Economic Zones Act, 2005. The revised provisions replace rule 49(2) of the Special Economic Zones Rules, 2006 and take effect upon publication in the Official Gazette.
Why the amendment matters
SEZ units regularly supply goods to customers in the DTA on payment of applicable duty. Commercial transactions can fail after clearance because a buyer changes its requirements, market demand shifts, or contractual terms are not met. Previously, the process for returning those goods to an SEZ unit could create uncertainty around timing, documentation, duty treatment, and inventory controls.
The amendment expressly permits the return of such goods in defined cases. It also establishes separate rules for repairing goods previously supplied to the DTA. The practical result is greater operational flexibility, paired with clear safeguards intended to prevent duplicate tax or duty benefits.
Return of goods when a DTA buyer does not take delivery
An SEZ unit may bring back goods supplied to the DTA on payment of duty where the buyer fails to take delivery because of:
- A change in fashion;
- A change in market conditions; or
- A default in the sale agreementβs conditions.
The goods must be returned to the SEZ unit within 30 days from the date of clearance from the unit.
Conditions for return
The return is subject to three important compliance conditions:
- Goods must be identifiable. The Specified Officer must be satisfied that the returned goods are the same goods originally cleared by the SEZ unit.
- No buyer-side benefit can have been claimed. The SEZ unit must provide evidence satisfactory to the Specified Officer that the DTA buyer has not availed any benefit, including input tax credit, in relation to the goods.
- A separate auditable inventory is required. The unit must maintain a distinct inventory record for returned goods in an auditable format.
These conditions make traceability central to the revised rule. Units should therefore be able to link the original clearance, buyer documentation, transport records, receipt of returned goods, and inventory entry for each transaction.
Re-sale in the Domestic Tariff Area
Returned goods may be sold again in the DTA, either to the original buyer or to another buyer. However, the goods must be re-sold without any alteration to their original condition.
The re-sale is treated as a fresh DTA sale for duty purposes. Applicable duty must be paid under section 30 of the SEZ Act, 2005, as though the goods were being sold into the DTA for the first time.
This provision gives SEZ units a way to recover value from returned goods while preserving the applicable duty framework. It does not permit the unit to alter the goods before re-sale under this specific return-and-resale provision.
Refund treatment for duties
The amendment separately addresses the duty consequences of the original clearance and the subsequent return:
- A refund of duty paid when the goods were originally cleared is to be sought from the appropriate authority in accordance with rule 47(5) of the SEZ Rules.
- Refund of duties relating to goods brought back to the SEZ is governed by the Customs Act, 1962.
This means that a return does not automatically eliminate the need for duty-refund procedures. SEZ units must follow the relevant process under the SEZ Rules for the original clearance and the Customs Act for duties associated with the returned goods.
Repairs of goods supplied to the DTA
The amendment also provides a dedicated route for returning goods to an SEZ unit for repair. Goods that were supplied to the DTA on payment of applicable duties may be brought back to the unit for repairs within:
- Six months from the date of clearance; or
- Any longer period allowed by the Specified Officer; or
- The applicable warranty period,
whichever is later.
On completion of repairs, duty is payable on the value of the repairs. As with returned goods, the identity of the goods must be established to the satisfaction of the Specified Officer.
The warranty-period provision is particularly significant for businesses handling durable or technical products, where a repair requirement may arise beyond the initial six-month window.
Key compliance considerations for SEZ units
The amended rule makes documentation and internal controls essential. SEZ units handling DTA returns or repairs should maintain records that support:
- The date and details of the original DTA clearance;
- The reason the buyer did not take delivery, where goods are returned for commercial reasons;
- Proof that the DTA buyer did not claim input tax credit or another benefit;
- Product identity, including serial numbers, batch details, descriptions, or other traceable markers;
- Separate, auditable stock records for returned goods;
- The original condition of goods intended for DTA re-sale; and
- Repair valuation and warranty documentation for goods returned for repair.
Bottom line
The 2026 amendment gives SEZ units a defined legal route to receive back duty-paid DTA goods that were not accepted by buyers, re-sell them in the DTA, and repair goods returned by customers. Its commercial flexibility is balanced by strict requirements on timelines, proof of product identity, evidence that buyers have not claimed benefits, auditable inventory controls, and duty compliance.
