The Central Board of Indirect Taxes and Customs (CBIC), under the Ministry of Finance, has released Instruction No. 15/2025-Customs dated 12th June 2025, directing all Customs zones and formations to refer to a newly launched Consolidated Repository on SCOMET clarifications, now available on the CBIC website.

This initiative has been launched to ensure consistent, accurate interpretation and implementation of India’s export control regime, particularly concerning SCOMET items (Special Chemicals, Organisms, Materials, Equipment and Technologies), as governed under the DGFT framework.

What is SCOMET?

SCOMET refers to a category of dual-use items—goods, technologies, and software that can be used for both civilian and military applications—regulated under India’s Foreign Trade Policy (FTP).

Exports of SCOMET items are regulated, and in many cases, require prior authorization from DGFT.

Key Highlights of Instruction No. 15/2025:

1. Consolidated Repository Launched

  • A dedicated section on the CBIC website has been created to host all SCOMET-related clarifications received from DGFT.
  • This will serve as a single-point reference for customs officials and stakeholders.

2. Periodic Updates Assured

  • The repository will be updated regularly as and when new clarifications are received from DGFT, ensuring real-time policy alignment.

3. Clarifications Are Only Guiding Tools

  • CBIC has clarified that the repository is for ease of reference only.
  • Each export case must be individually examined for SCOMET coverage based on:
    • Technical specifications,
    • End-use declarations,
    • Export destination,
    • Exporter’s history and documentation.

4. Internal Sensitization Required

  • All field formations are directed to sensitize officers under their jurisdiction for strict compliance with export policy conditions related to SCOMET.

  • Prevents misclassification or oversight in SCOMET item exports.
  • Promotes transparency and uniform interpretation across Customs zones.
  • Reduces compliance uncertainty for exporters of sensitive technologies.

CBIC’s Message to Field Formations

Customs officials are advised to:

  • Review the updated repository frequently,
  • Not rely solely on the clarifications listed,
  • Carry out due diligence on a case-by-case basis,
  • Report implementation issues or policy gaps to CBIC for further review.
