CDSCO Introduces Fast-Track Clearance for Drug Sample Shipments by Foreign Regulators

In a significant move to ensure the timely testing and release of lifesaving drugs, the Central Drugs Standard Control Organization (CDSCO), under the Ministry of Health and Family Welfare, has issued a circular to streamline the clearance process for drug sample shipments sent by foreign National Regulatory Authorities (NRAs) to India. This directive, dated December 9, 2024, aims to prevent delays in testing and ensure that safe, efficacious, and high-quality drugs are made available without unnecessary hindrances.

Why This Directive Matters

Foreign NRAs often send drug samples to India for testing at authorized laboratories to verify their safety and quality before releasing them for public use. However, delays in clearing these shipments at Indian ports have been a concern, as they can impact the timely availability of critical drugs. Recognizing the importance of expediting this process, CDSCO has now mandated fast-track clearance for such shipments, provided certain conditions are met.

Conditions for Fast-Track Clearance

To ensure smooth processing, the following conditions must be fulfilled for drug sample shipments sent by foreign NRAs:

Authorized Sender: The drug samples must be sent exclusively by the concerned National Regulatory Authority of the foreign nation.

Non-Commercial Use: The shipment must be accompanied by an undertaking stating that the samples have no commercial value and are intended solely for testing, examination, or analysis.

Authorized Laboratories: The analysis must be conducted at a drug testing laboratory that holds valid permission in Form-37.

Disposal of Residual Samples: Any residual samples after testing will not be returned but will be disposed of by the testing laboratory in accordance with applicable procedures.

Implementation and Stakeholders

The directive has been communicated to all zonal, sub-zonal, and port offices (air/sea) of CDSCO. Additionally, stakeholders have been informed through the CDSCO website to ensure widespread awareness and compliance.
