Dated: 06.12.2025

In a significant development, the Hon’ble High Court at Calcutta has quashed the anti-dumping duty levied on imports of Titanium Dioxide originating in or exported from China PR. This decision, delivered on September 22, 2025, in the case of India Paint Association vs. Union of India & Ors (WPO 148 of 2025), has led to immediate changes in customs procedures across India.

Background

The anti-dumping duty on Titanium Dioxide imports from China was initially imposed through Notification No. 12/2025-Customs (ADD) dated May 10, 2025. The duty aimed to protect domestic industries from unfair pricing practices by foreign exporters. However, the India Paint Association challenged this notification in court, leading to the recent judgment.

Calcutta High Court Judgement- Indian Paint Association Versus Union of India & Ors. (WPO 148 of 2025)

The Indian Paint Association challenged the anti-dumping duty on Titanium Dioxide (Rutile Sulphate) imports from China, citing procedural lapses and lack of transparency by the DGTR. The Calcutta High Court quashed the final findings and the duty, ruling that the investigation violated principles of natural justice and remanded the case for reconsideration.

Court’s Decision

The Hon’ble High Court ruled in favor of the India Paint Association, quashing the notification that imposed the anti-dumping duty. The court’s decision was based on legal and procedural grounds, effectively nullifying the duty on Titanium Dioxide imports from China.

Impact of the Decision

Following the court’s order, the Central Board of Indirect Taxes & Customs (CBIC) issued Instruction No. 33/2025-Customs on December 5, 2025, directing all field formations to stop collecting anti-dumping duty on Titanium Dioxide imports from China with immediate effect. This directive ensures compliance with the court’s ruling and provides clarity to importers and stakeholders.

What This Means for Businesses

The removal of the anti-dumping duty is expected to benefit industries that rely on Titanium Dioxide, such as paint manufacturers, plastics, and cosmetics. Importers can now source this essential raw material from China at competitive prices, potentially reducing production costs and boosting profitability.

Conclusion

The High Court’s decision marks a pivotal moment for businesses importing Titanium Dioxide from China. It underscores the importance of judicial oversight in ensuring fair trade practices and compliance with legal procedures. As the industry adapts to this change, stakeholders must stay informed about further developments and updates from the government.
