Extension of Anti-Dumping Duty on Flexible Slabstock Polyol Imports from Saudi Arabia and UAE
The Government of India has issued Notification No. 01/2026-Customs (ADD) on January 2, 2026, announcing the extension of anti-dumping duty on imports of “Flexible Slabstock Polyol of molecular weight 3000-4000” originating in or exported from Saudi Arabia and the United Arab Emirates. This decision comes as part of a review initiated by the Directorate General of Trade Remedies (DGTR) under Notification No. 7/03/2025-DGTR dated March 18, 2025.
Background of Anti-Dumping Duty
Anti-dumping duties are imposed to protect domestic industries from unfair trade practices, such as the dumping of goods at prices lower than their normal value in the exporting country. In this case, the anti-dumping duty on Flexible Slabstock Polyol was originally imposed by Notification No. 20/2021-Customs (ADD) dated April 5, 2021, and was set to expire. However, the DGTR initiated a review to assess the need for its continuation, as per sub-section (5) of section 9A of the Customs Tariff Act, 1975, and rule 23 of the Customs Tariff (Identification, Assessment, and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995.
Key Details of the Notification
The latest notification extends the anti-dumping duty on Flexible Slabstock Polyol imports from Saudi Arabia and UAE until June 17, 2026, unless revoked, superseded, or amended earlier. This extension is aimed at ensuring the protection of domestic manufacturers from injury caused by dumped imports.
The notification amends the principal Notification No. 20/2021-Customs (ADD) by inserting a new paragraph, which explicitly states the extended validity of the anti-dumping duty. The principal notification was last amended by Notification No. 78/2021-Customs (ADD) dated December 29, 2021.
Implications of the Extension
- Protection for Domestic Industry: The extension of the anti-dumping duty will provide continued protection to Indian manufacturers of Flexible Slabstock Polyol, ensuring a level playing field against unfairly priced imports.
- Market Stability: By curbing the influx of dumped goods, the government aims to stabilize the domestic market and prevent price distortions that could harm local businesses.
- Encouragement for Local Production: The move is expected to encourage domestic production and investment in the industry, fostering growth and employment opportunities.
Legal Framework
The extension is in accordance with sub-sections (1) and (5) of section 9A of the Customs Tariff Act, 1975, and rules 18 and 23 of the Customs Tariff Rules, 1995. These provisions empower the government to impose and extend anti-dumping duties based on the findings of the designated authority.
Conclusion
The extension of the anti-dumping duty on Flexible Slabstock Polyol imports from Saudi Arabia and UAE reflects the government’s commitment to safeguarding domestic industries from unfair trade practices. This decision underscores the importance of maintaining a fair and competitive market environment while supporting local manufacturers. Stakeholders in the industry should take note of this development and plan their strategies accordingly.
