CBIC Extends Anti-Dumping Duty on Polyethylene Terephthalate (PET) Resin Imports from China
The Government of India has issued a notification imposing anti-dumping duties on imports of certain grades of Polyethylene Terephthalate (PET) resin. This measure aims to protect the domestic industry from unfair trade practices and ensure a level playing field for Indian manufacturers.
Background and Rationale
The decision follows a detailed investigation by the designated authority, which found:
- Positive and Significant Dumping Margin: All producers from the subject country (Peopleβs Republic of China) were found to have a positive and significant dumping margin and injury margin.
- Rising Imports Despite Existing Duties: Imports of PET resin have continued to increase at a high rate, even with duties already in force. Without further intervention, these imports are likely to rise further.
- Price Undercutting and Injury to Domestic Industry: Imported PET resin has been undercutting domestic prices, suppressing or depressing the prices of Indian manufacturers. This has caused material injury to the domestic industry.
Based on these findings, the authority recommended the continued imposition of anti-dumping duties to remove injury to the domestic industry.
Details of the Anti-Dumping Duty
The anti-dumping duty applies to PET resin with an intrinsic viscosity of 0.72 decilitres per gram or higher (commonly known as bottle-grade PET resin, excluding recycled PET resin). The specifics are as follows:

Duration and Applicability
- The anti-dumping duty will be levied for five years from the date of publication of the notification in the Official Gazette, unless revoked, superseded, or amended earlier.
- The duty is payable in Indian currency, with the applicable exchange rate determined as per the relevant government notifications at the time of import.
Legal Framework
This action is taken under the powers conferred by the Customs Tariff Act and the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995. It supersedes the previous notification (No. 18/2021-Customs (ADD) dated 27th March 2021), except for actions already taken under that notification.

- Domestic Industry: The duty is expected to provide relief to Indian PET resin manufacturers by curbing unfairly priced imports and stabilizing market prices.
- Importers and Exporters: Importers of PET resin from China or via China will need to factor in the additional duty cost. Exporters from China may see reduced competitiveness in the Indian market.
