Standardizing SEZ Export Container Sealing: Uniform RFID Seal Acceptance at Gateway Ports

The Ministry of Commerce & Industry, Government of India, has issued a significant directive to streamline and standardize the sealing procedures for Special Economic Zone (SEZ) export containers at all gateway ports. This move addresses operational challenges faced by SEZ units due to inconsistent sealing practices and aims to facilitate smoother trade operations.

Background: The Need for Uniform Sealing Practices

SEZ units have reported difficulties at gateway ports arising from non-uniform export container sealing methods. These inconsistencies have led to delays, confusion, and additional operational burdens for exporters and logistics providers. Recognizing these challenges, the government has taken steps to harmonize the process across all ports.

Key Directives from the Ministry

The new instruction mandates the following:

Exclusive Use of RFID Seals
- Only RFID (Radio Frequency Identification) seals are to be used on SEZ export containers that are covered under valid Let Export Orders (LEOs).
- This directive is in accordance with CBIC Circular No. 41/2017-Cus. dated 30.10.2017, which outlines the use of RFID e-seals under a risk-based framework.
No Additional Sealing Requirements
- Gateway ports must not insist on any additional sealing mechanisms beyond the prescribed RFID seal for SEZ export containers.
- Liner seals, typically affixed by shipping lines, are not considered substitutes for customs-prescribed RFID seals unless specifically recognized under official procedures.
Uniform Acceptance Across All Ports
- The instruction ensures that SEZ export containers sealed with RFID seals are uniformly accepted at all gateway ports, eliminating discrepancies and facilitating seamless export operations.

All Zonal and Development Commissioners are directed to enforce this standardized sealing procedure. SEZ units and logistics providers should ensure that only RFID seals are used on export containers, as per the latest guidelines. Customs authorities at gateway ports are instructed to accept containers sealed in this manner without demanding additional seals.
