Security Deposit Requirements for Warehouse Registration under WDRA in India
The Warehousing Development and Regulatory Authority (WDRA) in India has established clear regulations for the requirement and management of security deposits for warehouses seeking registration. Key Highlights of the Security Deposit Notification
- No Fixed Security Deposit for Registration
- Applicants or Warehouse Service Providers do not need to furnish a fixed security deposit for obtaining a registration certificate from WDRA.
- However, if a warehouse intends to issue electronic Negotiable Warehouse Receipts (eNWRs), an Advance Dynamic Security Deposit (DSD) is mandatory before starting such business.
- Advance Dynamic Security Deposit (DSD) Requirements
- General Warehouses:
- Minimum βΉ1,00,000 per warehouse or an amount matching the value of eNWRs proposed to be generated.
- Farmer Producer Organisations, Primary Agricultural Cooperative Credit Societies, Self Help Groups:
- Reduced rate of βΉ50,000 per warehouse.
- The Advance DSD is adjusted against the monthly Dynamic Security Deposit as business progresses.
- General Warehouses:
- Dynamic Security Deposit Structure
- The DSD is calculated as a percentage of the maximum value of outstanding eNWRs (T) across all registered warehouses in the previous month:
- T β€ βΉ25 crores: 1% of T
- βΉ25 crores < T β€ βΉ250 crores: βΉ25 lakhs + 0.75% of T
- βΉ250 crores < T β€ βΉ2,500 crores: βΉ1.937 crores + 0.5% of T
- T > βΉ2,500 crores: βΉ13.187 crores + 0.25% of T
- For eligible FPOs, PACS, and SHGs, the total security deposit remains βΉ50,000 per warehouse.
4. Deposit Forms and Adjustments
- Security deposits can be made via bank fixed deposits, bank guarantees, e-bank guarantees, surety insurance policies, or other instruments as approved by WDRA.
- Certain entities may submit an Indemnity Bond instead, subject to WDRA approval and board authorization.
- The Advance DSD may be adjusted against the DSD requirement as determined monthly.
5. Duration and Refund of Security Deposits
- The Advance DSD must be maintained during the period of eNWR issuance and for six months after.
- The DSD is updated monthly and must be maintained for at least six months to accommodate any changes.
- Security deposits are refunded if:
- Registration renewal is rejected and obligations are fulfilled.
- The warehouseman surrenders the registration and WDRA accepts it.
- Registration is cancelled and obligations are fulfilled.
- No Security Deposit for Non-eNWR Warehouses
- Warehouses not issuing eNWRs are exempt from furnishing any security deposit.
- No Increase in Depositor Charges
- Warehousemen cannot increase charges for depositors during the validity of issued negotiable warehouse receipts, even if the security deposit requirements change.
- Applicability and Transition
- The new provisions apply only to applications made after the notification’s commencement date.
- Warehouses registered or pending registration before this date continue under previous rules.
Special Provisions and Formats
- Bank Guarantee Format:
- The notification provides a detailed format for submitting a bank guarantee as a security deposit.
- Indemnity Bond Formats:
- Entities created under an Act of Parliament or State Legislature, and Primary Agricultural Cooperative Credit Societies, may submit an Indemnity Bond in prescribed formats.
