BIS New Safety Standards for Machinery & Electrical Equipment
The Omnibus Technical Regulation (OTR) 2024 is a new safety regulation introduced by the Ministry of Heavy Industries, Government of India, under the Bureau of Indian Standards Act, 2016. This regulation sets forth mandatory safety standards, certification requirements, and compliance measures for machinery and electrical equipment sold or used in India.
Key Highlights of the Regulation:
- Title and Implementation:
- The regulation is named the Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024.
- Its effect from 28 August 2025 in the Official Gazette.
- The order applies to a specified list of machinery and electrical equipment (detailed in the First Schedule).
2. Scope and Application:
- Covers machines, electrical equipment, their assemblies, sub-assemblies, and components.
- Does not apply to products covered under other orders issued under Section 16 of the BIS Act, 2016.
- Excludes domestic goods manufactured for export and construction equipment governed by CMVR Rule 1989.
3. Conformity to Standards:
- Equipment must conform to Indian Standards (IS), classified into:
- Type A: General safety principles (e.g., IS 16819:2018 / ISO 12100:2010).
- Type B: Generic safety standards (listed in the Second Schedule).
- Type C: Detailed safety standards for specific machines (listed in the Third Schedule).
- In case of conflicts, Type C standards take precedence over Type A and Type B.
4. Certification Requirements:
- Mandatory BIS Certification: Machines and electrical equipment must carry a standard mark under a BIS license.
- Conformity Assessment: If continuous manufacturing is not intended, a Certificate of Conformity is required.
- Manufacturers must register with BIS before obtaining certification.
5. Market Surveillance & Enforcement:
- The BIS is the certifying and enforcement authority.
- Market surveillance will be conducted as per issued guidelines.
- Penalties apply for violations under the BIS Act.
6. Schedule-wise Categorization:
- First Schedule: Lists machinery and electrical equipment covered under this regulation, along with their HS Codes.
- Second Schedule: Defines Type B generic safety standards applicable to multiple machines.
- Third Schedule: Specifies Type C machine-specific safety standards.
Examples of Covered Equipment:
- Pumps, compressors, centrifuges, cranes, metal cutting machines.
- Textile machines, packaging machines, rubber & plastic processing machines.
- Electrical components like transformers, generators, switchgear, and control gear.
