New Quality Control Order for Cookware & Utensils
The Quality Control Order (QCO) of 2024 has been issued by the Ministry of Commerce and Industry, Government of India, under the Bureau of Indian Standards (BIS) Act, 2016. This order aims to ensure that cookware, utensils, and cans for food and beverages conform to specific Indian Standards for quality and safety.
Key Highlights:
- Mandatory Standard Mark:
- All specified products must conform to BIS standards and bear the Standard Mark under a BIS license as per Scheme-I of Schedule-II of the BIS (Conformity Assessment) Regulations, 2018.
- This requirement does not apply to goods manufactured exclusively for export.
2. Applicability and Exemptions:
- Micro and Small Enterprises (MSEs) have a phased implementation timeline as per the table in the order.
- Enterprises registered under the Udyam portal are exempt if:
- The investment in plant/machinery does not exceed โน25 lakhs.
- The previous financial yearโs turnover does not exceed โน2 crores (as certified by a Chartered Accountant).
- Enterprises registered under the Udyam portal are exempt if:
- Goods manufactured or imported before the orderโs implementation date are allowed to be sold for up to six months.
- Up to 200 units of cookware, utensils, and cans imported annually for research & development purposes are exempt, provided they are not sold commercially.
3. Certification and Enforcement:
- The BIS is designated as the certifying and enforcement authority.
- Any violations of the order will result in penalties under the BIS Act, 2016.
4. Implementation Timeline:
- The QCO was notified dtd 11th October 2024.
- Different product categories, such as stainless steel utensils, aluminum utensils, sinks, and cans, have specific implementation dates ranging from April 1, 2025, to October 1, 2025, with different dates for micro and small enterprises.
5. Product Categories Covered:
- Stainless Steel Utensils (IS 14756:2022)
- Wrought Aluminum Utensils (IS 1660:2009)Stainless Steel Sinks for Domestic Use (IS 13983:1994)
- Round Open-Top Sanitary Cans for Foods & Beverages (IS 9396:1987)
- Aluminum Cans for Beverages (IS 14407:1996)
Conclusion:
This QCO is aimed at enhancing product quality and safety for cookware, utensils, and cans used for food and beverages in India. It mandates BIS certification while providing certain exemptions for micro and small enterprises and goods used for research purposes. Non-compliance with this order will result in penalties under the BIS Act, 2016.
