- All covered goods must conform to the relevant Indian Standards and display the Standard Mark, which is only permitted under a BIS license.
- Licenses are granted exclusively to manufacturers supplying to entities with specific permission under this Order.
- Ongoing market surveillance is conducted by BIS, in collaboration with DPIIT, to ensure continued compliance.
3. Grant of Permission
- Permission to supply goods under this Order is granted by DPIIT to companies incorporated under the Companies Act, 2013, following a risk assessment by an Implementation Committee.
- The Implementation Committee comprises senior officials from DPIIT, Consumer Affairs, Commerce, Directorate General of Foreign Trade, BIS, and other relevant ministries.
- Assessment criteria include technical capability, quality assurance processes, compliance history, and commitment to developing supply chain capabilities in India.
- The Committee may request documents, certifications, and conduct interactions as part of its evaluation.
- Permissions can be suspended, modified, or withdrawn in case of non-compliance or misrepresentation.
4. Application Process and Duration
- Applications for permission must be submitted within 24 months from the Order’s commencement.
- Detailed guidelines on the application process, required documentation, and compliance monitoring are available on the DPIIT website (https://www.dpiit.gov.in).
- The Order remains in force for five years from its commencement, unless extended by the government. Permissions granted before rescission remain valid for their specified duration unless revoked.
5. Interpretation and Dispute Resolution
- Any questions regarding the interpretation of the Order are to be referred to DPIIT for resolution.
