The Government of India has issued a significant notification imposing anti-dumping duties on imports of Phthalic Anhydride from the People’s Republic of China, Republic of Korea, and certain other countries. This move aims to protect the domestic industry from unfair trade practices and ensure a level playing field for Indian manufacturers.

What is Phthalic Anhydride?

Phthalic Anhydride is a key industrial chemical used in the production of plasticizers, resins, dyes, and pigments. It falls under tariff item 2917 35 00 of the Customs Tariff Act, 1975.

Background and Rationale

The Directorate General of Trade Remedies (DGTR) conducted an investigation and concluded that dumping of Phthalic Anhydride from China and Korea has continued. The cessation of the existing anti-dumping duty would likely result in continued or renewed dumping, causing injury to the domestic industry. Based on these findings, the Ministry of Finance has decided to continue and update the anti-dumping duties.

Key Provisions of the Notification

  1. Scope of Goods and Countries
    • The anti-dumping duty applies to Phthalic Anhydride imported from:
      • People’s Republic of China
      • Republic of Korea
      • Goods exported from these countries, or from any other country if the origin is China or Korea
  2. Duty Rates and Applicability
    • The following duties are imposed:
      • From China (any producer, any exporter): 40.08 USD per metric ton (MT)
      • From Korea (any producer, any exporter): 140.17 USD per MT
      • Goods exported from China or Korea, regardless of origin: Same rates as above
    • Duties are payable in Indian currency, calculated at the exchange rate specified by the Ministry of Finance on the date of bill of entry presentation.
  3. Duration
    • The anti-dumping duty will remain in force for five years from the date of publication of the notification, unless revoked, superseded, or amended earlier.
