The Ministry of Environment Forest & Climate Change (MoEF&CC) has implemented the Extended Producers Responsibility (EPR) regime which is under implementation in Plastic Waste Management Rules, 2016, according to which it is the responsibility of Producers, Importers and Brand-owners to ensure processing of their plastic packaging waste through recycling, re-use or end of life disposal (such as co-processing/Waste-to-energy/Plasticto-oil/roadmaking/industrial-composting).

In order to streamline implementation process of EPR, the Ministry of Environment, Forest and Climate Change, Government of India, in its fourth Amendment to the Plastic Waste Management Rules, dated February 16, 2022, notified β€˜Guidelines on Extended Producer Responsibility for Plastic Packaging’ in the Schedule II of the Rules.Β As per these guidelines,Β Producers, Importers and Brand Owners (PIBOs)Β shall have to register through the online centralized portal developed by the Central Pollution Control Board (CPCB).

Accordingly PIBOs who are operating in more than two States with CPCB and those operating in one or two States/UTs shall be registered with the concerned State Pollution Control Boards (SPCBs). PWPs shall also have to register with the concerned SPCB/PCCΒ in accordance with the provisions of the Section 13(3) of the Plastic Waste Management Rules, 2016 on this centralized portal developed by CPCB.

The EPR Portal for Plastic Packaging provides provision for registration of PIBOs/ PWPS in accordance with the notified EPR Guidelines. The portal will help in improving accountability, traceability and transparency of fulfilment of EPR Obligations. The portal is planned to have seven modules, which allows registration of PWPs and PIBOs, issue certificates by PWPs & exchange of credits, allows real-time monitoring of transactions between PIBOs and PWPs, allows levy of environmental compensation and provides system generated reports and facilitates filing of annual returns for the stakeholders.
This portal has been commenced with two modules for registration of PIBOs and PWPs respectively. The remaining modules will be integrated shortly.

  1. What is Extended Producer Responsibility (EPR)

EPR means the responsibility of a producer for the environmentally sound management of the product until the end of its life.

  1. Which entities shall register on the centralized portal developed by CPCB?

The following entities shall register on the centralized portal developed by CPCB:

  1. Producer (P)
  2. Importer (I)
  3. Brand owner (BO)
  4. Plastic Waste Processor (PWP) engaged in (a) recycling, (b) waste to energy, (c) waste to oil, and (d) industrial composting.

 

  1. Which PIBOs are required to register with SPCB/PCC??

PIBOs which are operational in one or two states/UTs are required to register with the concerned with SPCB/PCC

2. Which PIBOs are required to register with CPCB??

PIBOs which are operational in more than two states/UTs are required to register with CPCB. Note: Brand Owners (BO) including online platforms/marketplaces and supermarkets/retail chains other than those, which are micro and small enterprises as per the criteria of Ministry of Micro, Small and Medium Enterprises, Government of India. For details refer to Section 3 & 4 of afore mentioned EPR Guidelines.

3. Which are the plastic packaging categories covered under EPR?

The following plastic packaging categories are covered under EPR: Category

I : Rigid plastic packaging Category

II : Flexible plastic packaging of single layer or multilayer (more than one layer with different types of plastic), plastic sheets or like and covers made of plastic sheet, carry bags, plastic sachet or pouches Category

III : Multilayered plastic packaging (at least one layer of plastic and at least one layer of material other than plastic) Category

IV : Plastic sheet or like used for packaging as well as carry bags made of compostable plastics For details please refer EPR Guidelines ( Refer to Section 5)

4. What is EPR target for Producers & Importers?

EPR target is the plastic waste which is introduced in the market by the PIBO. Details given in section 7 of the EPR Guidelines may be referred to.
