CBIC Imposes Anti-Dumping Duty on Sulphenamides Accelerators Imports
The Government of India, through the Ministry of Finance (Department of Revenue), has announced the imposition of anti-dumping duties on imports of Sulphenamides Accelerators from the People’s Republic of China, the European Union, and the United States of America. This measure is designed to protect the domestic industry from injury caused by unfairly priced imports.
What Are Sulphenamides Accelerators?
Sulphenamides Accelerators are chemical compounds widely used in the rubber industry, especially in the production of tires and other rubber products. The anti-dumping duty specifically covers the CBS (N-cyclohexyl-2-benzothiazolesulfenamide) and NS (N-tert-butyl-2-benzothiazole sulfenamide) forms, while excluding MOR and DCBS variants.
Rationale for the Duty
Following an investigation, the designated authority found:
- Landed prices from the subject countries were consistently below the cost of sales and selling price of Indian producers.
- Positive price undercutting was observed during the investigation period.
- Suppression of domestic selling prices over the injury period, indicating harm to the local industry.
Based on these findings, the authority recommended anti-dumping duties to counteract the injury to Indian manufacturers.
Scope and Applicability
The anti-dumping duty applies to imports of Sulphenamides Accelerators under several tariff items, including 2921 51 90, 2930 30 00, 2931 90 90, 2934 20 10, 2934 20 90, 2934 99 90, 3812 10 00, 3812 20 90, 3812 31 00, 3812 39 10, 3812 39 20, 3812 39 30, and 3812 39 90. The duty is imposed on goods originating in or exported from China, the EU, and the USA, as well as certain transshipments through other countries.
Duty Structure
The duty rates vary by country of origin, country of export, and producer. Below is a summary table:
| SN | Country of Origin | Country of Export | Producer | Duty (US$/MT) |
| 1 | China | Any | Any | 974 |
| 2 | Other* | China | Any | 974 |
| 3 | European Union | Any | Lanxess Belgium N.V. | 1257 |
| 4 | European Union | Any | Others | 1748 |
| 5 | Other* | European Union | Any | 1748 |
| 6 | USA | Any | Lanxess Corporation | 75 |
| 7 | USA | Any | Others | 192 |
| 8 | Other* | USA | Any | 192 |
*Other: Any country except China, EU, and USA.
Compliance Requirements
- For imports from Lanxess Belgium N.V. (EU) and Lanxess Corporation (USA), the lower duty rates apply only if a valid commercial invoice with a specific declaration is presented to customs. Otherwise, the higher rate for other producers applies.
- The anti-dumping duty is effective for five years from the date of notification, unless revoked or amended earlier.
- Duties are payable in Indian currency, with the exchange rate determined as per the Customs Act at the time of presenting the bill of entry.
Implications for Stakeholders
For Importers
- Ensure correct documentation, especially when importing from specified producers to benefit from lower duty rates.
- Factor in the additional cost of anti-dumping duties when planning imports of CBS and NS forms of Sulphenamides Accelerators.
For Domestic Industry
- The measure is expected to provide relief from unfair price competition, stabilize market prices, and support the financial health of Indian manufacturers.
For Exporters
- Exporters from China, the EU, and the USA must be aware of the new duties and ensure compliance with Indian customs requirements.
Conclusion
The imposition of anti-dumping duties on Sulphenamides Accelerators is a significant regulatory step to protect India’s domestic rubber chemicals industry from injurious dumping. All stakeholders should review the detailed requirements and ensure full compliance to avoid penalties and disruptions in trade.
